Treadwell Auctions conducts live bidding through the LiveAuctioneers.com auction platform.

Please register to bid through the LiveAuctioneers.com in advance of 12 EST the day prior to the auction to ensure your ability to bid.

We request that winning bidders either personally collect or make shipping arrangements for any won lots within 14 days following the sale date. To make shipping estimates easier, weight and measurement details are included in lot descriptions.

By participating in a sale via this online platform, you acknowledge that you are bound by these Conditions of Sale. TA has no control over, and assumes no responsibility for, the content, privacy policies or practices of any bidding platforms. Your dealings with LiveAuctioneers.com is solely between you and that bidding platform. We encourage you to read the terms and conditions and privacy policy of any bidding platform you visit.

Under no circumstances are TA or our consignors liable for any damages, lost profits or any special, incidental, or consequential damages that result from the use of or the inability to use LiveAuctioneers.com. 

A total buyer’s premium of 32% will be added to the hammer price of every lot and is payable by the winning bidder as part of the total purchase price.

Some of the lots offered in the sales are subject to a reserve, which is the confidential minimum price below which the lot will not be sold.

Upon the fall of the auctioneer’s hammer or termination of online bidding, the contract between the consignor and the purchaser is concluded and the winning bidder thereupon will immediately pay the total purchase price.

Title on a purchased lot will not pass until TA has received in full the total amount of the purchase price and the funds have cleared.

Unless exempted by law the purchaser will be required to pay New York sales tax and any additional applicable compensating use tax of another state.

TA reserves the right in its sole discretion at any time to withdraw, combine or divide any lot and shall have no liability whatsoever for such withdrawal, combination or division.

Successful bidders will be invoiced directly by LiveAuctioneers. The purchaser’s obligation to immediately pay the full purchase price is absolute and unconditional.

All payments are to be made to TA through either the Live Auctioneers platform, by check to Treadwell Auctions, LLC or with cash (up to $5000).

Any check returned because of insufficient funds will be subject to additional bank fees.

Purchased property must be removed from TA within 14 days of purchase. If the property is not removed within 14 days, TA reserves the right to charge a storage fee of $20 per lot per day. 

Property will not be released to the successful bidder until the purchase price has been paid in full. Please note that TA reserves the right to refuse payment from a source other than the buyer of record.

It is the purchaser’s sole responsibility to arrange collection or shipping of the purchased property and to identify and obtain any necessary permits for the lot. TA and the consignor make no representations or warranties as to whether any lot is or is not subject to export or import restrictions or embargoes.

Purchasers are reminded that TA’s liability for loss or damage to sold property shall cease no later than 14 days after the date of the auction.

These Conditions of Sale as well as bidders’, the purchasers’ and our respective rights and obligations hereunder shall be governed by and construed and enforced in accordance with the laws of the State of New York. 

By bidding at an auction, whether by agent, order bid, online or other means, all bidders including the purchaser shall be deemed to have consented to the exclusive jurisdiction of the state courts of, and the federal courts sitting in, the State of New York.

By registering to bid at auction, you hereby enter into, and agree to be bound and to comply with the following terms and conditions.

AS IS- all property is sold ‘as is’ without representation or warranties by TA or the consignor, express or implied, as to the correctness of the catalogue or other description of the authenticity, size, rarity, quality, medium, frame, period date, age, exhibitions, importance of provenance, literature or historical significance or relevance, attribution, fitness for particular purpose and no statement anywhere, whether oral or written, whether made in the catalog, sales room posting or announcement, invoice, condition report or elsewhere, shall be deemed such a warranty, representation or assumption of liability.

All lots will be available for inspection prior to the auction either during the posted public preview or prior to the sale by appointment. TA strongly urges and advises prospective bidders to examine any lots in which they are interested personally, prior to auction. 

While TA is not obligated to provide a condition report, condition reports for most lots can be found online on both the TA website (treadwellauctions.com) and bidding platform (liveauctioneers.com). Potential bidders are encouraged to contact TA for additional condition information on any lot. TA does not warrant the condition of any lot. 

The absence of a condition report does not imply that the lot is in perfect condition or completely free from imperfections, wear or effects of aging. Condition reports provided as a courtesy by TA – whether online or at a person’s request – are based on a visual inspection and for guidance only. Such condition reports should not be relied on as statements of fact and do not constitute a representation, assumption of liability or warranty by TA. Condition is a subjective evaluation, and the final responsibility rests with the buyer to assess the condition of any item sold by TA.

TA and the consignor are not responsible for errors and omissions in the catalogue or any supplemental material. Any description of a lot’s dimensions and weights is approximate. No description or report about a lot is a substitute for your own examination of a lot.

TA and the consignor make no representation or warranty, express or implied, that the purchaser will acquire any copyright or reproduction rights in any property.

In no event will our liability to a purchaser with respect to an item of property exceed the purchase price actually paid by such a purchaser for such item.

The copyright in all written material, images and illustrations produced by TA relating to auctions and lots is, and shall remain at all times, the property of TA and shall not be used by the buyer nor by anyone else, without prior consent. 

TA reserves the right to reproduce any image of the lots sold in any of its sales.
